Cyber Advertising


Assalamu alaykum,

I have recently started working in marketing and have to make advertisements for the organisation. One way in which I contribute is by making videos which has led to ponder about the following:

  1. What sound effects are halal?
  2. Is it halal to include women in these videos? If so, is it halal to include a woman who is not wearing the full hijab?
  3. Is it halal to include non-Muslim women not wearing the full hijab?
  4. Is it haram to include sounds that were not produced using instruments, but sound as though they were?

As my discipline is I.T I also have the following questions:

  1. Is it halal to download ‘fake’ software off the likes of private bay. For example, if I wanted Microsoft Office but the price is quite high, is it halal to download a free version from a website that distributes it. Often times these websites share their own software information and allow you access to their product. However, this is usually in violation of the terms and conditions of the company such as Microsoft.
  2. What is the ruling regarding purchasing stolen credit cards when the card is owned by people that the Muslims are at war with the intention of using this money for the sake of Allah?

In the name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-raḥmatullāhi wa-barakātuh.

  1. It is not permissible to use musical effects such as beats etc.[1] Income earned from selling and advertising music is Ḥarām. You may play non-musical Anāshīd (Islamic poems) as your background sound.
  2. It is not permissible to include the faces of men or women in the videos. [2]
  3. It is also not permissible for you to include faces of non-Muslim women.
  4. See point 1
  5. Using a pirated version of Microsoft is breaching copyright laws. If one is caught doing so, he may have to face severe consequences. We advise you to avoid using a pirated version of Microsoft and purchase the official software.
  6. It is not permissible to purchase such stolen credit cards.

فى المعراج: الملاهي نوعان: محرم وهو الآلات المطربة من غير غناء كالمزمار سواء كان من عود أو قصب كالشبابة أو غيره كالعود والطنبور…والنوع الثاني مباح وهو الدف فى النكاح وفي معناه ما كان من حادث وسرور ويكره في غيره…وهو مكروه للرجال على كل حال…ونقل البزازي فى المناقب الإجماع على حرمة الغناء إذا كان على آلة كالعود وأما إذا كان بغيرها فقد علمت الاختلاف

وقال أبو حنيفة: لا تجوز الإجارة على الغناء والنوح. وكذلك قال أبو يوسف ومحمد

وقال أبو حنيفة: لا تجوز الإجارة على شيء من اللهو والمزامير أو الطبل. ولا تجوز الإجارة على الحداء ولا على قراءة شعر ولا غيره. ولا تجوز الإجارات في شيء من الباطل

[الاستئجار على الغناء]

م: (قال) ش: أي القدوري – رَحِمَهُ اللَّهُ -: م: (ولا يجوز الاستئجار على الغناء) ش: بكسر الغين وبالمد وبالكسر مع القصر اسم لليسار، وبالفتح مع القصر الإقامة، ومع المد الكفاية

أما الأول من غنى بالتشديد غناء وأما الثاني من غنى يغني من باب علم يعلم غنى فهو غني وأما الثالث من غني بالمكان أي أقام وهو أيضا من الباب المذكور وأما الرابع من قولهم ما يغني عنك هذا أي ما ينفعك م: (والنوح) ش: البكاء ورفع الصوت م: (وكذا سائر الملاهي) ش: كالمزمار والطبل وغيرهما، وبه قالت الثلاثة وأبو ثور الاستئجار على حمل الخمر

م: (لأنه استئجار على المعصية والمعصية لا تستحق بالعقد) ش: إذ لا يستحق على أخذ شيء يكون به عاصيا شرعا. وقال شيخ الإسلام الأسبيجابي في شرح ” الكافي “: ولا تجوز الإجارة على شيء من الغناء والنوح والمزامير والطبل أو شيء من اللهو ولا على الحداء وقراءة الشعر ولا غيره ولا أجر في ذلك، وهذا كله قول أبي حنيفة وأبي يوسف ومحمد، لأنه معصية ولهو ولعب

عَنِ ابْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صلى الله عليه و سلم قَالَ : إِنَّ المُصَوِّريُنَ يُعَذَّبُونَ يَوْمَ الْقِيَامَةِ، وَيُقَالُ : أَحْيُوا مَا خَلَقْتُمْ
