Nikāḥ on Social Media

Question:

Asssalmu Alaikum,

There is a girl I like and I straightly wanted to marry her, no dating-nothing. Although we never meet each other neither we ever talked but one day via social media I told that […], and this answer was openly seen on the internet. In fact still it is. Now after reading the fatwa (http://islamqa.org/hanafi/askimam/81042/is-a-secret-marriage-valid-without-the-girl-having-the-walis-approval), it seems that we are married, because I proposed her and she said yes and it has been witnessed openly by the people on the internet.

Now can I send her the link above and tell her that we are almost married even though we are not, because she has started seeing someone recently and I have clear projection that she might commit adultery with him sooner or later. Whereas if can let her believe that we are married and try to marry her properly again with proper formalities then I can save her from dating that guy and the probable adultery with him.

So shall I send her the fatwa (http://islamqa.org/hanafi/askimam/81042/is-a-secret-marriage-valid-without-the-girl-having-the-walis-approval) and tell her that we are married?

Answer:

In the name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-raḥmatullāhi wa-barakātuh.

You state that you have not met nor spoken to the girl in reference. It is then quite surprising that you reached the conclusion that you “like” her and wish to take her as your life partner.

Nevertheless, the method of Nikāḥ described by you is not a legitimate method of Nikāḥ in Islām. For the Nikāḥ to be valid, Ījāb and Qabūl (proposal and acceptance) have to take place in the same meeting (اتحاد المجلس) in the presence of at least two male Muslim witnesses or one male witness and two female witnesses. Thus, your ‘marriage’ with the girl in reference is null and void to begin with.[1] Furthermore, you should refrain from peeking into people’s lives, including the girl in reference via social media and stalking them. If the girl in reference is indulged in an illegitimate relationship, then the burden of sin will be upon her and not you. We advise you to repent for your wrong actions and if you wish to marry, then you must follow the correct Shar’ī procedure.

قال الامام علاء الدين ابو بكر بن مسعود الكاساني الحنفي ت : ٥٨٧ هـ : وأما الذي يرجع إلى مكان العقد فهو اتحاد المجلس إذا كان العاقدان حاضرين وهو أن يكون الإيجاب والقبول في مجلس واحد حتى لو اختلف المجلس لا ينعقد النكاح، بأن كانا حاضرين فأوجب أحدهما فقام الآخر عن المجلس قبل القبول، أو اشتغل بعمل يوجب اختلاف المجلس، لا ينعقد؛ لأن انعقاده عبارة عن ارتباط أحد الشطرين بالآخر، فكان القياس وجودهما في مكان واحد، إلا أن اعتبار ذلك يؤدي إلى سد باب العقود؛ فجعل المجلس جامعا للشطرين حكما مع تفرقهما حقيقة للضرورة، والضرورة تندفع عند اتحاد المجلس، فإذا اختلف تفرق الشطرين حقيقة وحكما فلا ينتظم الركن

وأما الفور فليس من شرائط الانعقاد عندنا … هذا إذا كان العاقدان حاضرين فأما إذا كان أحدهما غائبا؛ لم ينعقد حتى لو قالت امرأة بحضرة شاهدين: زوجت نفسي من فلان وهو غائب فبلغه الخبر فقال: قبلت أو قال رجل بحضرة شاهدين: تزوجت فلانة وهي غائبة فبلغها الخبر فقالت: زوجت نفسي منه لم يجز، وإن كان القبول بحضرة ذينك الشاهدين وهذا قول أبي حنيفة ومحمد

ولو أرسل إليها رسولا وكتب إليها بذلك كتابا فقبلت بحضرة شاهدين سمعا كلام الرسول وقراءة الكتاب جاز ذلك لاتحاد المجلس من حيث المعنى؛ لأن كلام الرسول كلام المرسل؛ لأنه ينقل عبارة المرسل وكذا الكتاب بمنزلة الخطاب من الكاتب، فكان سماع قول الرسول وقراءة الكتاب سماع قول المرسل وكلام الكاتب معنى وإن لم يسمعا كلام الرسول وقراءة الكتاب لا يجوز عندهم
