Question:

I have strong waswasa about divorce. I being very careful regarding arguments with my wife. A year back there was argument between my wife and me on something. I said that I will do 2nd marriage only to tease my wife, she said mae zaher kha ker Mar jao gee. I said in anger Mar, jaan chor. But there was no intension to divorce. I immediately sat down and become anxious whether this costitute divorce. One year passed, but there are recurrent waswasa regarding this issue, whether my nikah valid.

Answer:

In the name of Allāh, the Most Gracious, the Most Merciful

As-salāmu ‘alaykum wa-raḥmatullāhi wa-barakātuh

Divorce has not taken place in this situation[1]. Do not entertain these waswasahs (doubts).

قال أبو القاسم السمرقندي في الفقه النافع: وبقية الكنايات إذا نوى بها الطلاق كانت واحدة بائنة عندنا، لأن اللفظ يدل على البينونة. (المستصفى في شرح النافع ٢/١٩٧ – مكتبة الارشاد)

قال الموصلي: (وكنايات الطلاق لا يقع بها الا بنية أو بدلالة حال)لاحتمالها الطلاق وغيره، لأنها غير موضوعة له فلا يتعين الا بالتعيين، وهو أن ينويه أو تدل عليه الحال، فتترجح ارادته. (الاختيار لتعليل المختار ٣/١٦٦ – الرسالة العالمية)
