Specific Ṭalāq Query

Country: United Kingdom

Selaam alaikom,

My question is that my wife started working and I once said to her that “if you speak with any man outside of work I will never live with you again” and yes I did mean this as talaaq. Just 2 weeks into work she was seen by my family talking to 3 men in the smoking area (my wife doesn’t smoke), so I was very angry with her and I we had a massive argument I didn’t go near her for a few days but eventually family got involved and I just thought I’d forgive her. But does that mean any talaaq occurred, and if so is it talaaq Bain or talaaq raj’i?
The reason I ask is because it’s been 7 months and this has been on my mind.

JazaakAllah khairan

In the name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-raḥmatullāhi wa-barakātuh.

Your statement, “If you speak with any man outside of work, I will never live with you again” will not constitute a Shar‘ī Ṭalāq since you have used the future tense. Hence, your marriage is still intact.[1] However, you should refrain from making such sensitive statements, as one should not take Ṭalāq matters lightly and should exercise caution in this regard.

And Allah Ta‘ālā knows best

By using the future tense, i.e., saying, “I will” one is expressing his desire to carry out the action in future. For this reason, Ṭalāq will not take place.
