Query Regarding Jana’iz

Question:

Do we the hanafi has any proof from the ahadith supporting:

1) Imam standing by the chest of the mayyit in janazah salaah.
2) Making the whole body of the mayyit facing the qiblah while it is placed in the qabr.
3) The funeral rites of a hajee who passes away in the condition of ihram is similar to the general

Answer:

In the Name of Allāh, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-raḥmatullāhi wa-barakātuh.

1) The mas’alah is mention in multiple books of fiqh.

Allamah Shurumbulali rahimahullah (d.1069h) mentions, “The imam must stand by the chest of the deceased, whether the body is of male or female”[1]

Allahmah Abdullah ibn Mahmud (d. 683h) also mentions this issue and mentions the hadeeth that Samura ibn Jundub radiallahu anhu narrates that Rasulullah salallahu alayhi wasallam prayed salat al janazah for a woman and stood by her chest” [2]

Allamah Abu Bakr ibn Abi Shaybah rahimahullah (d.235h) has brought a narration in his Musannaf under the chapter “with regards to a woman where must the musalli stand, and with regards to man…”, “on authority of Ataa’ radiallahu anhu who said that when a man prays on a Janazah, he must stand by the chest” [3]

Fuqaha’ also mention that we stand by the chest because that is the place of Imaan. It is as though the Musalli gives testimony to the imaan of the deceased.

According to one narration of Imam Abu Hanifah rahimahullah, the Musalli should stand in the middle of the woman to conceal her. The hadeeth for this is mentioned in Bukhari Shareef on authority of Samura ibn Jundub radiallahu anhu who narrates that I prayed behind Nabi salallahu alayhi wasallam in Janazah for a woman who passed away in her pregnancy (or in another wording nifas) , so he stood at middle of her.[4]

Allamah Marghinani rahimahullah (d.593h) author of Al Hidayah explains that the Janazah of the woman in the later case was not concealed by a bier, hence the Imam stood as a barrier.[5] Allamah Alla’ud deen rahimahullah (d.587h) answers by saying that praying by the chest is itself the middle, so the wordings of “in the middle of her” also incorporate the chest as well. The only difference being that perhaps Rasulullah salallahu alayhi wasallam leaned towards the head at some times, and towards the lower body at others causing the narrator to think that there was a difference.[6]

2) The opinion of the Hanafi madhab with regards to turning the deceased towards the Qibla is that only the face should be turned towards Qibla.

Allamah Shurumbulali rahimahullah (d.1069h) states under the discussion of burial in his treatise “Nur al Idaah”, “and turn the face (of the deceased) towards Qibla towards his right side”.[7]

The evidence of this is the hadeeth mentioned in Sunan Abi Dawood which mentions that one Bait al Haram is Qibla for our living and the deceased. [8] The narration is also mentioned in al Mustadrak of Al Hakim and is the basis for the opinion of Sheikhayn rahimahumullah. Al Hakim has graded this hadeeth as Saheeh. Allamah ibn al Abideen (d.1252h) rahimahullah has mentioned that although the apparent text shows that it is Wajib just like for living to face the Qibla, however at Tuhfah’s text mentions that it is sunnah.[9] Allamah Zafar Uthmani rahimahullah (d.1394h), author of I’laa’ as Sunan has classified it as Sunnah Ghayr Mu’akkadah.[10]

3) Allamah Alla’ud deen rahimahullah (d.587h) explains the issue in his monumental al Bada’i al Sana’i saying, “A Muhrim (a person in ihram) will be given a shroud just like a non-Muhrim according to us. This means that his head and face will be covered, and fragrance will be applied to him.

Contrary to this Imam Shafi’i holds says that a Muhrim’s head will not be covered and fragrance shall not be applied to him. He takes evidence from the narration of ibn Abbas radiallahu anhu who said that Rasulullah salallahu alayhi wasallam was asked about a muhrim who had been killed by his camel and he replied, “Bathe him with as sidr and shroud him in his clothes and do not cover his head for he will be raised reciting talbiyah”. In another narration it comes, “and do not bring fragrance close to him.”[11]

Our evidence is what Ataa’ narrates from ibn Abbas radiallahu anhuma, who mentions from Nabi salallahu ῾alayhi wasallam tha he said with regards to a Muhrim who had passed away, “cover him and do not imitate him like the jews”[12]. Another narration which is our evidence is the statement of Ali radiallahu anhu with regards to a muhrim, “when a person passes away, his ihram desists”. [13] Rasulullah salallahu alayhi wasallam said, “When a son of Adam dies then all their actions desist except for three, a pious child who will pray for him, a sadaqah jaariyah, and knowledge which he taught people with which people benefit.” Ihram is not from these three actions. Hence the hadeeth which came before is contradictory to these, and in such a case we retain the generality of the hadeeth we mentioned that this action of Ihram desists at the death of someone. Thus that narration will be interpreted as a specific exclusion for that particular occasion. [14]

332 – حدثنا أحمد بن أبي سريج، قال: أخبرنا شبابة، قال: أخبرنا شعبة، عن حسين المعلم، عن عبد الله بن بريدة، عن سمرة بن جندب: «أن امرأة ماتت في بطن، فصلى عليها النبي صلى الله عليه وسلم، فقام وسطها»( صحيح البخاري (1/ 73))

2875 – حدثنا إبراهيم بن يعقوب الجوزجاني، حدثنا معاذ بن هانئ، حدثنا حرب بن شداد، حدثنا يحيى بن أبي كثير، عن عبد الحميد بن سنان، عن عبيد [ص:116] بن عمير، عن أبيه أنه حدثه، وكانت له صحبة أن رجلا سأله، فقال: يا رسول الله ما الكبائر؟ فقال: «هن تسع» ، فذكر معناه زاد: «وعقوق الوالدين المسلمين، واستحلال البيت الحرام قبلتكم أحياء وأمواتا» (سنن أبي داود (3/ 115))

1851 – حدثنا يعقوب بن إبراهيم، حدثنا هشيم، أخبرنا أبو بشر، عن سعيد بن جبير، عن ابن عباس رضي الله عنهما، أن رجلا كان مع النبي صلى الله عليه وسلم، فوقصته [ص:18] ناقته وهو محرم، فمات، فقال رسول الله صلى الله عليه وسلم: «اغسلوه بماء وسدر، وكفنوه في ثوبيه، ولا تمسوه بطيب، ولا تخمروا رأسه، فإنه يبعث يوم القيامة ملبيا» (صحيح البخاري (3/ 17))

2772 – ثنا أبو بكر النيسابوري , نا محمد بن علي السرخسي , نا علي بن عاصم , عن ابن جريج , عن عطاء , عن ابن عباس , عن النبي صلى الله عليه وسلم في المحرم يموت , قال: «خمروهم ولا تشبهوا باليهود» (سنن الدارقطني (3/ 368))

[13] وقال بعض أهل العلم: إذا مات المحرم انقطع إحرامه ويصنع به كما يصنع بغير المحرم (سنن الترمذي ت شاكر (3/ 277))

[14] ثم المحرم يكفن، كما يكفن الحلال عندنا أي: يغطى رأسه ووجهه ويطيب، وقال الشافعي: لا يخمر رأسه ولا يقرب منه طيب واحتج بما روى ابن عباس «أن النبي – صلى الله عليه وسلم – سئل عن محرم وقصت به ناقته واندق عنقه فقال: اغسلوه بماء وسدر وكفنوه في ثوبه ولا تخمروا رأسه فإنه يبعث يوم القيامة ملبيا» وفي رواية قال: «ولا تقربوا منه طيبا» ولنا ما روي عن عطاء عن ابن عباس عن النبي – صلى الله عليه وسلم – أنه «قال في المحرم يموت: خمروهم ولا تشبهوهم باليهود» وروي عن علي أنه قال في المحرم: إذا مات انقطع إحرامه ولأن النبي – صلى الله عليه وسلم – قال: «إذا مات ابن آدم انقطع عمله إلا من ثلاثة: ولد صالح يدعو له، وصدقة جارية وعلم علمه الناس ينتفعون به» والإحرام ليس من هذه الثلاثة وما روي معارض بما روينا في المحرم فبقي لنا الحديث المطلق الذي روينا أن هذا العمل منقطع على أن ذلك الحديث محمول على محرم خاص جعله النبي – صلى الله عليه وسلم – مخصوصا به بدليل ما روينا (بدائع الصنائع في ترتيب الشرائع (1/ 308)
